BPA and baby bottles: dates and regulations.

Bisphenol A is used for the production of polycarbonate baby bottles. This substance, with the heat, content in foods could be released into the bottle and, therefore, be potentially harmful to the health of newborns.

Despite the lack of scientific evidence on health damage caused by the use of baby bottles containing Bisphenol A, the Commission has decided to apply the precautionary principle, establishing a preventive measure to ban use of the substance for the production of bottles .

Therefore, as established by the directive, Member States shall prohibit, by adopting a specific piece of legislation before 15 February 2011, the manufacture of such products as from 1 March 2011, and from 1 June 2011 will be prohibited the marketing.

The extreme detail of the Directive is that, according to settled case law of the Court of Justice, the possible lack of national implementation not be exempted from complying with the European standards, under penalty of possible liability claims made by persons ritenutisi damaged by failure to apply the directive.
